| Court of Equity, Spring Term A.D. 1860 | |
| Guilford County |
| To the Honorable the Judge of said Court: |
| The Petition of PARTHENIA PEGRAM, WILLIAM C.
PEGRAM, RHODY J. PEGRAM, and JOHN L. PEGRAM, JESSE L. PEGRAM and DANIEL P. PEGRAM, the
last three being infants under the age of twenty one years, who sue by their next friend
William C. Pegram; respectfully showeth unto your Honour that Daniel Pegram, late of said
county, died intestate since the last term of this Honourable Court without a wife,
leaving heirs surviving, your petitioners, his children and only heirs at law, upon whom
his real estate descended, between them equally to be divided, as tenants in common, each
one of his said children being entitled to one sixth part thereof. And your petitioners
further show, that the said Intestate at the time of his death, was seized in fee simple
of a tract of land situated in the County aforesaid, on the waters of Haw River; adjoining
the lands of William Lowe, one Whiteheart and others, and containing about two hundred and
twenty nine acres. And your petitioners further show that they desire to have partition of said land made amongst them according to their respective rights and interests therein but that owing to the size of said tract to land, the number of the parties interested, the nature and quality of the soil, and other causes, it is impossible that actual partition thereof can be made, without serious injury to the parties interested. Your petitioners therefore pray your Honour to order a sale of said land, on such terms as your Honour shall deem just and reasonable, and that the proceeds of the sale may be divided among them according to their respective shares and interests in the said land, and may be paid to, or secured for them according to law, and the course of this Honourable Court. And your petitioners, as in duty bound will ever pray. R. Gorrell & Julius L. Jarrell Solicitors for the Petitioners. |
